GENERAL TERMS AND CONDITIONS OF SALE

1.- Price

-The price set for the displayed items and models does not include assembly and transport services, which will be added to the price of the item and will be expressly and separately stated in the Order Form, with acceptance and confirmation by the customer.

-The prices set shall be understood to include VAT at the applicable rate at any given time, which will be itemized when issuing the corresponding invoice-receipt.

-Payment of the price of the purchased items must be made in full at the time of placing the order, through accepted online payment methods or through financing granted via consumer credit lines.

2.- Order

- Any order must be accepted and confirmed by the customer, which implies full acceptance of these general terms and conditions of sale.

-The order cannot be cancelled once it has been formalized, as the items purchased and detailed in the Order Form are made expressly at the customer's request. Therefore, once the order is placed, it cannot be totally or partially cancelled, nor can changes be made to dimensions, model, or upholstery color. If the customer intends to cancel an order, BARIMUEBLE SL will retain 50% of the price of the item in question as compensation for the cancellation. In the event that the order cannot be supplied by BARIMUEBLE SL according to the dimensions, model, and upholstery color agreed in the Order Form, except as provided in section 5.1 of these general terms and conditions of sale, BARIMUEBLE SL will refund the amount received to the customer.

3.- Warranties

- In compliance with the provisions of Book Two, Title IV, of Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Protection of Consumers and Users (hereinafter the Law), the items purchased and listed in the Order Form are subject to warranty in favor of the buyer from the moment of delivery or when they are made available, under the following terms:

-BARIMUEBLE shall be liable for any lack of conformity existing at the time of delivery of the purchased items listed in the Order Form (Art. 114 of the Law).

- If the delivered items are not in conformity with the contract, the customer may choose between replacement or repair, unless one of these options is impossible or disproportionate (Art. 120 of the Law).

-Products shall be deemed to be in conformity with the contract (Art. 116 of the Law) when they match the description provided at the time of the Order Form and possess the qualities presented to the consumer through the displayed models, with the usual functionality, quality, and performance of a product of the same type as the one delivered.

-BARIMUEBLE, S.L. shall be liable for any lack of conformity that becomes apparent within three years from delivery of the item (Art. 120 of the Law). In such case, the consumer must inform the seller of the lack of conformity immediately upon becoming aware of it (Art. 123.5 of the Law).

- The exercise of warranties or any claim by the buyer must be made in writing, either by burofax, registered mail, or any other means that provides proof, and the Order Form or Invoice-Receipt must always be attached.

-The warranty does not cover defects or damage caused by negligence, impacts, improper use beyond commonly accepted use, nor those resulting from normal wear and tear of materials, nor those due to environmental factors, nor those arising from the use of harmful cleaning products, or from improper assembly or disassembly carried out by personnel not belonging to the company.

4.- Other information

- In the event that the products offered and sold by BARIMUEBLE SL come from automated production processes subject to variations in tones, patterns, and knots of the boards, modular sets and similar shall be considered compliant when there is harmony in color and pattern, even if there is not total uniformity in all elements of the selected furniture.

-For the maintenance and care of the purchased items, BARIMUEBLE SL recommends:

-do not use cloths or objects that may scratch the surface of the furniture.

-before using a cleaning product for the first time, apply it to a small, inconspicuous part of the item to observe the results; proceed with full cleaning only if satisfactory.

-avoid contact with chemical and abrasive products.

-do not dismantle or move the furniture without professional assistance.

-avoid excessive light and humidity on the furniture.

5.- Personal Data Protection

- In compliance with Regulation (EU) 2016/679 and Organic Law 3/2018 of December 5, you are informed that the data provided will be processed by BARIMUEBLE, SL.

Your data will be processed for the purpose of managing the relationship between us, providing pre-contractual and contractual services, supplying the requested information and/or maintaining mutual communication by contacting you through any telematic, telephone, or similar means. You are informed that you may exercise your rights of access, rectification, erasure, restriction, portability, and objection, as well as withdraw your consent by sending a written request, along with a copy of your ID, to the following postal address: Calle Berlín 13, Pol. Having read these General Terms and Conditions of Sale, the buyer expressly accepts them as proof of acceptance and agreement.
